Retail Advantage Terms of Use
The Retail Advantage service is provided to you by Applied Relational Technology Limited
This document is an End User Agreement – This contains some important terms to which you as an Authorised User must agree on behalf of yourself and your organisation in order to use the Retail Advantage Services.
1.0 Obligations
1.1. Definitions: For the purposes of this document,
1.1.1. ‘the ‘Provider’ means Applied Relational Technology Limited;
1.1.2. ‘Client’ means the company (managing agent, landlord, shopping centre or other contracting partner) who has procured the Services for Authorised Users to access;
1.1.3. ‘Authorised Users’ means those tenants, associated staff and other personnel who are authorised by Client to use the Services;
1.1.4. “Services’ means the Retail Advantage software and associated services made available to Authorised Users by ART; and
1.2. Acceptable Use – Authorised Users shall:
1.2.1. comply at all times with the terms of this Undertaking and provide the Provider with all reasonable co-operation in relation to the provision of the Services and all reasonable access to such information as may be required by the Provider in order to perform the Services;
1.2.2. keep a secure password for use of the Services and other documentation provided to it by the Provider and keep their access details confidential;
1.2.3. not knowingly access, store, distribute or transmit any Malware, or any material during the course of its use of the Services that:
(a) is unlawful, harmful, threatening, defamatory, obscene, infringing, harassing or racially or ethnically offensive;
(b) facilitates illegal activity;
(c) depicts sexually explicit images;
(d) promotes unlawful violence;
(e) is discriminatory based on race, gender, colour, religious belief, sexual orientation, disability; or
(f) is otherwise illegal or causes damage or injury to any person or property;
(g) and ART reserves the right, without liability or prejudice to its other rights to Client, to disable an Authorised User’s access to any material that breaches the provisions of this clause.
1.3.4. use reasonable endeavours to prevent any unauthorised access to, or use of, the Services and/or any documentation provided to it by the Provider and, in the event it becomes aware or has reasonable suspicions of any such unauthorised access or use, promptly notify the Provider.
1.3. The Provider shall:
1.3.1. have the ability to change access codes, usernames, passwords or other security information necessary to access the Services as is necessary for operational reasons;
1.4.2. not be responsible for the performance of the internet and the subsequent impact this may have on the ability for Authorised Users to access the Services on their particular device (whether this be phone, laptop or similar electronic device); and
1.4.3. not be responsible for anything that adversely interferes with the provision of the Services that is caused by, whether purposely or unknowingly, any use by Authorised Users.
